POLISH SEJM PASSES REPRIVATIZATION BILL
We have learned that the Polish Sejm (Parliament) has passed
a Reprivatization Bill, ending ten years of debate over how to
settle the issue of nationalization of properties carried
out by the Communist Regime in Poland in the 1940's.
The Sejm's legislation provides that the return of properties will
be limited to claimants who were citizens of Poland at the time of
confiscation, and were still Polish citizens and residents of
Poland as of December 31, 1999. Eligible claimants are to
receive 50% of the value of their property in kind and government
bonds.
This bill, which was passed by the Polish Parliament on January
11, 2001, still needs to be passed by the Polish Senate and signed
by the President of Poland before it becomes law.
The position of the Polish American Congress is as follows:
This issue of property ownership in Poland is a matter to be
resolved by the current democratic Polish government -- however,
those issues which concern Poles residing in United States are of
interest to us. We believe that these issues should be resolved
according to a Polish law that will take into
account the rights and interests of all the former owners and
their legal heirs, regardless of their current country of
residence. We also anticipate that the process of property
evaluation will be clearly defined and issues will be resolved
equitably.
